1. Agreement to Terms

By accessing our website or engaging HCA Group (HC Architectural Drawings (Pty) Ltd) for architectural, construction, or bond origination services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Architectural Services & Intellectual Property

All architectural drawings, 3D renders, and structural blueprints produced by HCA Group remain the exclusive intellectual property of HC Architectural Drawings (Pty) Ltd until full and final payment has been received.

Re-use or reproduction of our designs for separate plots of land without explicit written consent and licensing agreements is strictly prohibited and violates South African copyright law.

3. Construction Timelines & Quotations

Construction quotations provided by HCA Group are valid for thirty (30) days from the date of issue due to the volatility of material costs.

While we utilize elite project management to ensure turnkey delivery, any presented construction timelines are estimates. HCA Group is not liable for delays caused by municipal approval pipelines, severe weather conditions, national strikes, or material shortages outside our direct control.

4. Bond Origination Disclaimers

Our bond origination service acts as an administrative intermediary between the client and registered South African financial institutions.

HCA Group does not guarantee loan approval or specific interest rates. Final credit vetting, risk profiling, and bond approval are entirely at the discretion of the respective banks (e.g., Standard Bank, FNB, Absa, Nedbank). You are obligated to provide entirely accurate and truthful financial declarations during this process.

5. Client Responsibilities

You are responsible for ensuring that the physical property site is accessible to our construction and surveying teams on agreed-upon dates. You must also ensure that all municipal rates, taxes, and sectional title levies (if applicable) are up to date prior to municipal plan submissions.

6. Limitation of Liability

To the maximum extent permitted by South African law, HCA Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, resulting from your use of our digital platforms or services.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa. Our services comply with the standards set by the South African Council for the Architectural Profession (SACAP), the National Home Builders Registration Council (NHBRC), and the Construction Industry Development Board (CIDB).
